1 It is conduct which in these circumstances falls to be dealt with in the trial itself by judicial control upon admissibility of evidence , the judicial power to direct a verdict of not guilty , usually at the close of the prosecution 's case , or by the jury taking account of it in evaluating the evidence before them .
