1 A child can not be required to attend a hospital or mental nursing home as an in-patient for the purposes of examination unless the court is satisfied on the evidence of a registered medical practitioner , that : ( i ) the child may be suffering from a physical or mental condition that requires , or may be susceptible to treatment ; and ( ii ) a period as a resident patient is necessary if the examination is to be carried out properly ( para 4(3) ) .
