1 2.9 If on one or more occasion the carrying out of the Works is delayed in consequence of any circumstance beyond the control of the Landlord which the Landlord could not [ reasonably ] have prevented or avoided then on each such occasion the Landlord shall be allowed such extension of time for carrying out the Works as may be certified by the Architect as being reasonable having regard to the delay in question and the date by which the Landlord is required to carry out the Works as provided in clause 2.8 shall be postponed accordingly The problem here is the uncertainty from the tenant 's point of view , hence the suggestion that there be inserted a long stop date ( see clause 2.8 ) .

5 ( 7 ) On remitting a case to a licensing board under subsection ( 6 ) above , the sheriff may : ( a ) specify a date by which the rehearing by the board must take place ; modify any procedural steps which otherwise would be required in relation to the matter by or under any enactment ; and any decision of a licensing board on any such case shall be valid as if reached at a quarterly meeting as mentioned in section 4(1) ( a ) of this Act .
6 However it is clear that in practice some limitation would have to be imposed on any such principle .
7 the bankruptcy of some person who is or may become beneficially entitled to any such property or income ; or 2. an assignment of or a charge on any such property or income being made or given by some such person ; or 3. in the case of a marriage settlement , the death of both parties to the marriage and of all or any of the children of the marriage ; or 4. the death under the age of 25 or some lower age of some person who would be beneficially entitled to that property or income on attaining that age .
8 ( 1 ) An appeal which may be made by virtue of any provision of this Act against any decision of a licensing board shall be to the sheriff , and the decision of the sheriff on any such appeal may include such order as to the expenses of the appeal as he thinks proper .
9 A clause achieving this would be as follows : As regards voting in general meetings the holders of the Preference Shares shall be entitled to receive notice of , and to attend at , general meetings of the Company but shall not in respect of their holdings of such shares be entitled to vote upon any resolution unless : ( A ) there shall have been any Arrears on any Preference Shares or Preferred Ordinary Shares for more than two months on the date of the notice convening the meeting ; or ( B ) the Company , on any of the Redemption Dates under sub-paragraph ( d ) ( i ) below of this Article 2.2 , shall have failed or been unable to redeem all or any of the Preference Shares falling to be redeemed on any such Redemption Date ; or ( C ) the resolution is one which directly or indirectly varies , modifies , alters or abrogates any of the rights , privileges , limitations or restrictions attaching to the Preference Shares or " A " Ordinary Shares ; or ( D ) the resolution is for the winding up of the Company , the reduction of share capital , the approval of the giving of financial assistance or the purchase by it of any of its shares .
10 No dilatory Motion with respect to , or in the course of , proceedings on the Bill shall be moved in the Standing Committee or on an allotted day except by a member of the Government , and the Question on any such Motion shall be put forthwith .
