8 The application of the UCTA 1977 to non-consumer indemnities will depend not merely on the clause , but on the nature of the liability in respect of which it is invoked , as is illustrated by the decisions of the Court of Appeal in Phillips Products Ltd v Hyland [ 1987 ] 2 All ER 620 and Thompson v T Lohan ( Plant Hire ) Ltd ( JW Hurdiss Ltd , third party ) [ 1987 ] 2 All ER 631 .

18 ( 2 ) In relation to each application for a new licence , the list mentioned in subsection ( 1 ) above shall specify the name , designation and address of the applicant ; in the case of an application to which section 11 of this Act applies , the names , designations and addresses of both persons named in the application ; the address of the premises in respect of which the licence in desired ; the type of licence for which application is made ; the first day of the meeting of the licensing board at which the application is to be considered .
19 ( 3 ) In relation to each application for the regular extension of permitted hours , the list mentioned in subsection ( 1 ) above shall specify ( a ) the name , designation and address of the applicant ; ( b ) the address of the premises in respect of which the application is made and the type of licence held in respect of those premises ; the nature of the extension of hours for which application is made ; the first day of the meeting of the licensing board at which the application is to be considered .
20 ( 3 ) At such adjourned meeting the licensing board may , if it is satisfied that the terms specified by the board have been complied with ( a ) proceed to grant the licence to the applicant or , as the case may be , to his executors , representatives or disponees ( being possessed of the premises in respect of which the application has been made ) ; ( b ) proceed to consider the objection , whether on the part of the objector or , in the case of a deceased objector , on the part of his representatives ; as if the preliminary requirements of this Act had been complied with .
21 ( 2 ) A licensing board may order the suspension of a licence on one or both of the following grounds : ( a ) that the licence-holder is no longer a fit and proper person to be the holder of a licence ; ( h ) that the use of the premises in respect of which the licence is held has caused undue public nuisance or a threat to public order or safety .
22 Any provision should also take account of the obligations in respect of other running expenses , such as business rates .
23 The tenant undertakes to do nothing which would put in jeopardy the continuation of the licence in respect of the premises .
